Congress created the U nonimmigrant visa to protect victims of qualifying crimes who have suffered substantial mental or physical abuse due to the crime and are willing to help law enforcement in the investigation or prosecution of the criminal activity. But how do you show that a client has actually suffered a qualifying crime? What if the crime listed on the police report does not match the enumerated crimes at INA 101(a)(15)(U)(iii)?
