So your survivor client got a removal order, either recently or in the past – what are their options to still find protection? When can they file a motion or an appeal of the removal order? Is a stay of removal automatic with a motion or appeal of the underlying order? When should they consider going to federal court? What if the client decides they don’t want to fight the order – will they still be able to use the consular process in the future? In this intermediate level webinar, we dive into the various options, with a special focus on survivor-based arguments. Where relevant, we report on recent instances of these maneuvers in practice, to provide practical advice for preparing the strongest application possible.
