Immigrant Survivors in Court: Multiple Defenses, Multiple Options

This two-day conference is intended for intermediate attorneys and DOJ Accredited Representatives who have experience or interest in working with immigrant survivors in removal proceedings before the Immigration Court.

ASISTA attorney experts will be joined by other national leaders in the field to discuss the latest developments in defending immigrant survivors before EOIR. Day One will focus on forms of relief available to immigrant survivors, including considerations when your client is applying for more than one of them. Day Two will dig into the details of other less formal strategy options, like seeking termination with the agreement of ICE-OPLA or dismissal based on a legally deficient Notice to Appear. Topics for discussion include recent precedential decisions and changes to the law; how to make the most of policy shifts; and the latest recommendations and practical tips from practitioners well-experienced in front of immigration judges.

Aug. 21 – Day ONE: Multiple Defenses (12-5 pm ET)

Session One: (2 hrs.) 12:00-2:00 pm ET

Refresher on Survivor-Based Relief in Proceedings: In this session, we center ourselves for the rest of the conference with a high-level review of the main survivor-based forms of relief, VAWA-based adjustment, VAWA Cancellation of Removal, U status, and T status. We will discuss issues unique to the removal setting, such as jurisdictional intricacies and obtaining continuances to pursue relief before USCIS.

Session Two: (2 hrs.)  3:00-5:00 pm ET

Pursuing Asylum Claims Involving Gender-Based Violence: To offer a complement to ASISTA’s usual focus on U, T, and VAWA-based relief, this session will focus on gender-based asylum claims. Panelists will review the current state of play for these claims and key doctrinal aspects to be aware of. We will also discuss best practices and common pitfalls to avoid when bringing these claims, whether you view asylum as your primary form of relief for the client or not.

Aug. 22 – Day TWO: Multiple Additional Options (12-5 pm ET)

Session Three: (1.5 hrs.) 12:00-1:30pm ET

Termination of Proceedings and Prosecutorial Discretion for Survivors: In this session, we will cover the newly effective EOIR rule “Efficient Case and Docket Management in Immigration Proceedings,” and policy-based strategies for representing survivors in removal proceedings, including prosecutorial discretion with OPLA and the ICE Victim-Centered Approach. Discussion will include both the intent and implementation of the policies, and how the new EOIR rule may affect representation of survivors in removal proceedings.

Session Four: (1 hr.) 2:00-3:00 pm ET

Knowing What to Notice in the Notice to Appear: If you’re having trouble keeping up with the latest challenges to an NTA, you’re not alone! Still, knowing when proceedings should be dismissed for a deficient NTA is an essential aspect of removal defense. Panelists will bring you up to date on all you need to know about an NTA to know if it passes muster.

Session Five: (1.5 hrs.) 3:30-5:00pm ET

Experts Roundtable: To round out the conference, we hear from experts on the many surprises and quagmires that can arise in the course of a removal case against a survivor. Drawing on questions from the audience and those that arise in ASISTA’s one-on-one strategy calls, we will discuss tips for client testimony issues, unexpected behavior from judges or OPLA attorneys, addressing cultural or language differences on the record, harnessing the new EOIR regulations, and other avant-garde practical advice.
