When a survivor of crime or trafficking is inadmissible, they must seek a waiver of inadmissibilities to gain approval of a U or T visa. Traditionally, these waivers have been sought from USCIS, but in several jurisdictions it is possible to seek them from IJs as well. For this special webinar, join Charles Roth, of the NIJC team that litigated IJ waivers in the US Court of Appeals for the Seventh and Eleventh Circuits, and Maria Baldini-Potermin, former Immigration Judge, as they discuss the legal bases for requesting an inadmissibility waiver from an IJ and the reasons it could benefit your client. Among other things, they will also describe current open questions in the legal landscape, and draw on their extensive experience to suggest practice tips when submitting a waiver request before EOIR.

Speakers:

  • Maria Baldini-Potermin, Attorney, Maria Baldini-Potermin and Assoc.
  • Charles Roth, Director of Appellate Litigation, National Immigrant Justice Center
  • Rebecca Eissenova, Senior Staff Attorney, ASISTA
